  • From ESTA to H-1B through Canada (by road)

    Hi,

    I am planning to enter the US with ESTA (Visa waiver program) and stay there a few days.
    I will need to start working for my new employer after 2 weeks and I already have my H-1B approved, although I do NOT have the I-797 form with me (it was mailed in the US and I will pick it when I arrive).

    Question: I know I cannot change from ESTA to H-1B while in the US.
    I will be in the Detroit area; can I cross the board with a car (Windsor) and enter back to the US in H-1B status?
    Will this cause any issue?
    Do I need any particular document in order to go to Canada?

      Maybe I should have clarified this, but I am not a Canadian citizen either and I plan to cross the board and re-enter the US right away.

          Alright, I am sorry I didn't give clear details in the first place.

          I am currently in Italy (I am an italian citizen), planning to enter the US with ESTA for a few days.
          While in Detroit, I am planning to cross the canadian board to Windsor and drive back to Detroit right away, getting entry in the US with H1B status this time.

          Is this plan ok?

              Ok, I've done this but I didn't receive any stamp on my passport while the online i94 still shows the old entrance through the ESTA program.
              I've specifically given the h1b documentation to the police officer.
              Am I good or not? How can I check if my immigration status has changed?
