Divorcing non-resident abroad (non-mutual)
Hi all, need some help.
I got married to a girl in India, but things did not work out and I would like to file a divorce. The girl is still in India, and right now it seems that divorce will not be mutual. Her family is creating trouble and all they are interested in is that "she gets to USA once, and then" they will consider agreeing mutual divorce.
If she never has never been to USA (her sponsorship process is still pending and I have applied for withdrawal), then:
Question # 1: Will I be liable to distribute my property or assets with her?
If I file the divorce here in US, and send summons via mail to her, then it is more likely that one of her random family members may receive and signed for it instead of her, as usually required but not followed strictly in India.
Question # 2: What are my options for pursuing a non-mutual divorce?
Question # 3: What are the steps and likelihood for getting ‘Motion and Verification for Alternate Service’ approved from a judge.
