  • Valid H4 but I-94 expiring soon

    Hi, I am on H4 visa staying with my husband, and I've approved I797 which is valid till 9/24/2017 but my I94 is expiring this year in November 2016. How can I file my I94 extension? Do I have to visit out of country to get my new I94 or is there any other way? If so, can only my husband's employer file my I94 extension or I can do it myself?
    Please help!!

    If you got a new I797, did it not have a new I94 at the bottom right corner?

      My H4 extension was filed 2 years ago (2014), when my passport was also expiring in 2 years (2016), I got I94 since November 2016 (at the bottom of I797)same as the date of my passport expiry but I got my I797 till September 2017. How to apply for I94 extension when my I797 is still valid till september of next year i.e. 2017?

        After you get a new passport, file I539 to extend I94. You can also try going to nearest CBP office an request for I94 extension, and may get it if lucky.
