Apply for K1 visa and J1 waiver
Hello, I'm planning to apply for the K1 visa, but I have some questions.
I participated in a Brazilian government exchange program (Science without Borders) and I lived in the US for 18 months with the J1 visa. I'm under the two-year rule and this may end by August 2017. But in January 2017 I will get a No-Objection statement from CAPES (my sponsor).
My question is: can I apply for the K1 visa in September 2016 and then in January 2017 use the no objection statement to apply for the waiver process for the two-year rule?
So when I have my visa approved I can move to the United States.
