  • Re-entry after staying outside US for 2 years

    Hello,

My wife and I both have a green-card. We had to come to India for a family emergency and could not apply for a re-entry permit on time before leaving the US. It's been about 2 years since we remained outside of the US. While in India we got a son, and that was one of the reasons we could not return back on time before one year period. Now we wish to return to the US as permanent residents with our son (Indian citizen, 18 months old). Is it even remotely possible? All the official rules say no. But would there be any chance to go back, if yes how would it work? I had a few questions and would greatly appreciate any advise in the matter.

    - Do we have to take the returning immigrant visa (SB-1) to enter?
    - Is it advisable to take our son along with us? As eventually we would like to apply for his greencard before he is 2 years?
    - Can we even try entering the US on greencard with supporting documents on why we had to overstay outside US (without SB-1)?
    - Will Indian authorities/airline allow to travel if overstayed outside US?

Any help here would be really helpful. If someone has done this before kindly help.

    Thanks,
