Hi,
I am looking for information and advice for obtaining a H-1B visa under the cap-exempt "remainder" option. I have previously worked in the US from Oct 2005 to May 2009 (3 years 9 months) under H-1B. The visa validity was till Sept-2012. I am currently looking to return to the US with a start-up and wanted some information regarding the recapture of remaining time in my prior application. My specific requirements would be as follows:
1. Could I obtain a H-1B under the cap-exempt "remainder" option as per the USCIS memo (link below) with a different employer. Would it be an issue if my new job profile might be slightly different?
2. What is the process/paper work and time involved in the same?
