Both USC and Non-Citizen live abroad - B-1 or K-1 if we intend to return abroad?

  • Both USC and Non-Citizen live abroad - B-1 or K-1 if we intend to return abroad?

    My fiance (non-citizen) and I (USC) BOTH live and work outside the US, but are considering getting married in the US and then both returning abroad shortly thereafter to our jobs (therefore without the intent to stay in the US). Three part question:

    1. Would it be advisable to do this on a B-1 Tourist Visa, since we will be returning aboard after the wedding? Or must it be a K-1 even for a temporary visit?

    2. Would this create issues in the future, if we later decided to both relocate to the US by applying for the CR1 visa from abroad, say a year or two after the wedding?

    3. Is it more challenging to apply for the CR-1 when the USC and Non-Citizen BOTH live abroad?

    B2 is appropriate. The USC must be domiciled in the US at the latest by the time foreign-national spouse enters the US on a IR\CR1 visa.
