  • Can we add spouse to the I-130 petition which is currently in process.

    Hi All,

My uncle, who is a permanent resident here in US has
filed an I-130 petition on Aug 2003 for his unmarried
sons who are in India. Currently the application
    status in USCIS site says..

"On April 18, 2006, your I130 IMMIGRANT PETITION FOR
RELATIVE, FIANCE(E), OR ORPHAN was received here for
processing. We will mail you a decision as soon as
    processing is complete. "

It would be really helpful if anyone can answer couple
of questions which is bothering my uncle.

    1. My Uncle's elder son got married last month, can
my uncle add his daughter-in-law to the current I-130
application which is is process now? if so what would
    be the procedure?

    2. I-130 application process has started on 18th
April 2006 in California center, can anyone like give a
very rough estimate like how long would this process
    take?

Thank you very much in advance!

    Best Regards,
    Harish

    Hi Dollyllama,

Thanks for the prompt reply. My Uncle's sons are over 21 years, when he filed for I-130 petition in Aug 2003. My uncle is a permanent resident and not a citizen... so the processing date for I-130 application in california center is Feb 7th 2005. My uncle has filed the petetion when his sons were not married, so according to your suggestion it is better not te declare their marriage as it will move the application to 3rd category?

The petetion was filed in Aug 2003 at Chicago,IL and the receipt number was given at that time... but now the application has been moved to California center ...and the status says that "we have received you application on Apr 18 2006 for processing" can you plz explain this.

    Thanks in advance!!
