L1B Rejected; Should I apply for L1-I or wait for H1B?

Hi,

I went through the L1B visa process at Chennai on October 20th, 2016. Unfortunately the CO said my petition is not clearly approvable and handed back my passport.

I have 2 options available right now:
1) Apply for L1 individual under premium processing
2) Wait for the H1B lottery results to come out

What are the rejection rates and processing times for an L1 individual? Please advice on the best possible action.

I would advise both. The earliest you can apply cap subject H1 is April 2017, and get H1 approved and travel on it would be Sep 2017 end, which is still 11 Months away, enough time to know the outcome of L1 individual.
