  • Help : Stamping Question

    Hello friends,

    - I have stamping until Aug 2017 with my old employer
    - Got a new passport in Jun 2016
    - H1 transfer started in Jun 2016 still in progress
    - Making H1 transfer premium now - Nov 2016

    1. Can I go to India When my H1 transfer is in progress.
    2. If I go to India now, Should I go for VISA stamping ?

    1. Advisable not to.
    2. Technically not required , but upon return you do need to have the H1 petition approval in hand , and even then it is highly likely that you will get I-94 only till Aug 2017 rather than the petition end date.

      1. Most probably, I will have H1 approved before I start.
      2. What if the new I-797 is longer than Aug 2017 ?

        Officers are generally giving I-94 only till Petition Expiry/Passport Expiry/Visa Expiry whichever is earlier.
