Unused H1B expired

Hi,

My H1B is expired on July 2015. I havent used that. I was in US and working in L1 with Company A when my H1B approved (Dec 2014) from Company B (6 months only valid H1B). I couldnt join due to some personal reason and returned back to india in 3 months after the approval. Now working in company A here. Though it was a change of state H1B, I haven't joined company B or used H1B.Is it eligible for H1B cap exempt through company B?

H1B unused and not visa stamped but expired in 1 year

My H1B was approved for 1 year from JAN-2016 to JAN-2017 .But I didn't traveled on it and its not visa stamped.Now its expiring in 07-JAN-2017.
1) Once its initial approval of 1 year expires in 07-JAN-2017 can I go for new CAP exempt petition on this expired petition ?
2)Can I change employer now ? will the new employer is eligible to file CAP exempt petition on this expired and unused petition ?
how to take it forward please advise
