  • How big chance on being denied for finance part on K1 visa

    Hi,
My fiance works 25 hours a week , 19 dollars and hour before taxes...
He moved from a smaller place to a bigger appartement a few months ago ,and used up all his savings for it to paint, get new things and pay extra bills.
Will all of this count against applying for a visa for me and my 2 kids?
How big is the chance of being denied ?

    Hey,
Financial situations have a lot to do with denials. It's called "public charge". It's one of the ineligibilities if the petitioner does not have enough income (annual) or cannot make up the difference with assets. If he/she can provide a joint sponsor who meets the poverty limits from the I-864p, then that joint sponsor can be used in lieu of the primary sponsor.
Right now, you can still apply for the I-129F, but when it's time for the interview at the Embassy, you must be prepared with proper supporting documents. You're not required to submit the I-134 at the I-129F stage.
    --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.
