Hi All,
My Wife and I are currently in the US on individual H1B's.
My Wife was employed by the same firm in India for more than 5 years. They had tried to apply for her L1-B from India, but it got rejected. She then travelled to the US on H4(as my dependent). The very next year the same firm applied for her H1B, which we got. It has been 3 years she has been serving the employer here in the US.
Both In India and US, she was performing the role of senior lead/Manager. Now my question here is, does my wife qualify for the EB1 category or she needs to go thru EB2?
