I140 under process.. and planning to change employer.. any impact on priority date?
Hi,
I have a situation.. my current employer is filling for my I-140 premium this week and i got an offer from another company XYZ this week. XYZ company wants to initiate my H1B transfer instantly & will also like to apply for GC. So Below are my questions :
1) Will this h1 transfer impact my ongoing i140 process? and when will my old employer know about h1 transfer? (i suppose he wnt know, but want to confirm if rules have changed).
2) If my new employer hr says they are initiating the h1 transfer today, can i start to work for them next day or should i wait till my h1 transfer is complete? usually how many days will it take in premium/expedite situations?
3) If for instance, my old employer comes to know about my h1 transfer and if he tries to revoke my i140 process.. or revoke my approved i140.. what happens then... when my new employer files for GC.. do i still get old priority date?
