  • When to apply for H1B extension

    Hi,
    When I came from India, my I797 end date was 27 July 2018, the end date in I94 is also 27 July 2018.
    I had to apply for H1B amedment due to location change.
    I got the amendment approved and now the new I797 has 12 Dec 2017 as end date.
    So which of this date should be considered for applying for H1B extension?
    Please help

    The latest petition will be the one active. Did it come with a new I-94 at the bottom, if yes then that is the date before which the extension will have to be filed.

      Thanks sir.
      I didn't get any I-94 in the latest petition.
      To double check I also pulled up the record from US Homeland Security website, the I-94 shows 27 July 2018.
      So which one needs to be considered in this case.

        If you didnt get an I-94 with the latest I797 then it would be a I797B and not an I797A. You cannot work at the new location till you leave US and re enter. I would advise you talk to your employer an attorney immediately.
