My visa expired in Feb 2017and extension for time recapture is in progress and my PERM is pending.
With new April order of stopping H1b premium processing. I have few queries to be asked.
1. I have around 180 days for recapture, if granted this will be in affect from last visa expiry date ?
2. If PERM/ I 140 is delayed by the time I get my H1 ext I have to exit the country. Right ?
3. If Perm/I140 is approved in another month or so but before my actual 6 year cap considering the time spent out of US border,
can I continue to stay in US despite my H1 recapture is still in progress ( can’t do premium bcos of the halt )?
4. If I change my visa status to H4 or F1 , will it still count to 6 year h1b cap and cause issues for me to apply H1 once I140 is approved ?
