  • H1 to F2 processing time more than 90 days?

    Hi ,

I was originally on F2 visa ( my spouse is student) and got H1B visa. I worked for 1.5 years and decided to go back to F2 again.
I applied for status change from H1B to F2 visa using I-539 form and my employer also cancelled my H1B. I recieved the receipt from USCIS that case was received. its already more than 60 days and my case did not get processed. I know that after H1B cancellation I can stay 90 days in USA without issues. I am not sure what to do if my case takes more than 90 days? can I stay legally in USA until my case gets processed completely? Can any one answer my question please.

    Thanks
    Uday
