      My PD is 1/17 - I submitted I-130‚I-485 & I-765 at the same time

      My I-130 has never been updated since it was entered into the online system (status date 1/25).

      My EAD has been approved and is in hand

      My I-148 interview has been scheduled for 6/7

      The I-797C NOA for the I-130 states

      The I-I130‚ Petition for Alien Relative has been received by our office for the following beneficiaries and is in process:

      Then my name / DOB / Country of Birth / Class are indicated below that followed by information underneath on how how to contact them if any of the info is incorrect.


      On my I-485 there has only ever been one update after the initial entry which indicates the interview letter was sent.

        Update to timeline!

        5/15 - I-130 sent with docs from New York City
        5/18 - package delivered
        5/19 - Receipt email
        5/22 - check cashed out of my account
        5/25 - I-797 arrived: "Petition has been received and is in process"
        7/27/17 - I-485, I-864, I-765 sent from New York City with I-130 Receipt Notice (as per latest I-485 instructions)

        So excited to get this going! It's been a struggle, but it's important to just keep it going!

              I just received the notice, but there's no instructions in it. It just says: Petition has been received and is in process.

              Is this what they mean?


              It meant that your application has been received and is in process. Usually USCIS sends I-797 NOA for Receipt notice (acceptance of your application) and when they have made a positive decision regarding your application, then you will receive another I-797 NOA for Approval Notice.

                I got 4 NOA and I also got biometrics appointment. Does that count as the positive decision regarding my application or no? Just a little confused.

                  A positive decision only comes after the interview. What you mentioned is just common practice.

                              Help! Marriage broke down during AOS!

                              Hi everyone,

                              I am sad to report that my 3 year marriage has broken down during my AOS application.
                              It can't get more dramatic than that.
                              We have i-130, i-485, and i-765 in progress, but my partner, the US citizen, will not follow through with it.
                              It's my fault, basically, since for the last three years I have been trying to get him back on track: he's a tax evader, collects welfare, has criminal records, addicted to alcohol and drugs, and what else I don't know!!!

                              I was making some pressure on him to get straight since his behavior can be a liability for my AOS, but, to no avail.
                              He prefers to end our marriage.
                              I honestly am relieved by the fact we are done.
                              I know however that complicates my AOS tremendously.
                              I have a lawyer and will check with him to see what can be done.
                              I don't know if the fact that I've been married to him protects me somehow.
                              I don't know if I should sue him for domestic abuse including using our relationship to play around my immigration status.
                              I don't know if I should go an IO and explain everything to IO.
                              Should I just divorce him and get married to someone else????

                              You won't believe but I am smiling right now. It's so bad that I am laughing through this situation and hope the guy up there will let me know what I should do.

                              You guys have been incredible, so you if you have gone through a situation like this or know someone who has, please enlighten me!

                              US citizen is not looking for divorce or looking to withdraw petitions (at least not right now), so I guess I still have time to figure out.
                              Biometrics was done last week.

                                I am very sorry to hear that. I'm glad you are happy. Maybe you should go for counseling with your hubby.
                                I wish you all the best. I hope you 2 work out.

                                Anyway, do talk to your lawyer first before any IOs.
