    Hello All,

I applied for my Parent B2 extension in mid May. When can I expect the response.

    1. What should I do if I Dont get response before there I94 expires?
    2. If they continue to stay after I94 expiry and they want to leave before extension decision comes would that be ok?
    3. what if # 2 happens and there is denial later?

Please help ...unable to get any leads

    Thank you very much ....

    1. She can stay until decision comes from USCIS or 240 days whichever comes first.
    2. yes.
    3. That should be fine because they left before the decision comes. Please ask them to save the extension receipt and I-94cards.

    Please find more information at,

There is no "240 days". One can always stay for as long as an Extension of Status or Change of Status application is pending, no matter how long that takes. This is true for all statuses. You may be thinking of the 240-day extension of employment authorization for H1b and things like that.

This is my personal opinion and is not to be construed as legal advice.
