  • Citizen, married a B2 Tourist visa holder

    Hello everyone,

I recently became a naturalized US citizen. I've been seeing someone in the last few months and we just got married. He is on a B2 visa here visiting in the US. I was divorced for some years and he was too. It has been a match made in heaven - we seem like just the right fit. We've come past abusive relationships and are much more understanding now in our new relationship.

We've decided to file for his I-485 and get his status changed. We know that we have to file the following. Has anything changed from this list?

I-485 - Application to Register Permanent Residence or Adjust Status (Fee required)

I-130 - Petition for Alien Relative (fee Required)

I-131 - Application for Travel Document

    G325A - Biographic Information

I-765 - Application for Employment Authorization

I-693 - Report of Medical Examination and Vaccination Record

I-864 | Affidavit of Support Under Section 213A of the INA.

    G-1145 - E-Notification of Application/Petition Acceptance

-Passport size pics of me and him
-Copies of marriage certificate and marriage license
-Copies of passport page for him
    - Copies of visa page for him
-Copy of valid ID for me
    - Copies of birth certificate for me and him

I hope I am comprehensive. Also, do you suggest getting a lawyer to file the paperwork? I know a lawyer who has helped me in the past with my paperwork- he is charging me 1500 for the paperwork for this status change.

i-130a and you dont need a lawyer unless it is a complicated case and certainly not to fill forms. there are several examples on here on how to do it yourself. $1500 is pretty step to fill in forms with information provided you and mailing them out. since your both divorced you will have to include your divorce decrees

I would definitely include what everyone else is suggesting but you definitely need more evidence to show that it is a bona fide marriage. Pictures, joint account statement, joint credit card and etc.

I also am a B2 immigrant but I came here in 2001 as a child. I have not committed any crimes and I have not left the country. Does your spouse have the I-94 form for arrival and departure? Make sure the birth certificate of your spouse is translated by a notary.
        Forms sent 6/2
        Forms received 6/4
        Received texts/e-mails 6/6
        PD 6/5 & 6/6
NOA between 6/8 and 6/12 (I was out of town)
Biometrics letter in mail 6/17 w/ 6/28 date
        SR 9/2
        Contacted Congressman 10/1
        Called the Congressman's office 10/10
        Interview letter 10/10
        Approval Letters for I-765 and I-131 10/16
        Received EAD/AP card 10/17
        Interview 11/8 RFE after
        New Card Being Produced 11/16
        Conditional GC received 11/24

The beneficiary still needs to fill out and sign form I-G325 and not the petitioner.

I am the same boat as you. I was overstay ( B2 expired). Met husband, in love and decided to get married. We've been together since 2001 but I was not legally divorce from my ex until 2005. Had a hard time getting all the proper paper works from my home country. Took us over 10 years to finally get all the necessary paper works. Got married after 16 years together.
I did not hire any immigration lawyer and everything went well so far. Just received my EAD. Still waiting on I-485 and I-130 to be approved, I am assuming either after or before the interview.

I sent( as bonafide marriage proof):
            Copy of hubby birth certificate
Certified and translated my birth certificate.
Certified and translated my divorce paper.
            Certified copy of marriage license.
            Utilities bills
            Joint bank account
            Life insurance policy
            Copy of car insurance
Copy of both our driver licenses
2 affidavit letters from our friends
            Letter from husband's employer
Receipt of household purchased( washing & dryer)
Plenty of pictures( one page with 4 or 5 pictures)

I also sent other requirements paperworks such as all of the forms, G-925 for me and hubby etc.

            Blessings
