I am an IT professional from India and working as a second line manager for a reputed software product company in US. I am currently on L1B. My green card has been filed under EB2 category. Since EB2 can take 15 years plus I am considering EB1C category which is for International Managers. This category requires, among other things, 1 year of continuous Manager experience during the last three years in the same organisation.
I currently donot have 1 year of manager experience outside of US.
In order to complete 1 year of Manager experience outside US I am considering working in another country where my company has software development centers. My company has a great global internal transfer policy. Here are the options I have:
1. GO to Canada (most convenient for me).
2. UK
3. or India
My question is:
Does going to Canada as Manager for 1 year and coming back in the same company satisfies the above mentioned eligibility criteria? Is it considered legal by immigration officials?
