  • How to do adjustment of status?

    Hello,

    i need to know how can i do adjustment of status from b-2 visa?

    and how organize the package?

            The U.S Citizen and his/her spouse generally need to file the following forms along with supplemental evidence and correct filling fees:

            Forms I-130 ($535)

            Form I-130 A

            Form I-485 ($1225) includes biometrics fee

            Form I-864, Affidavit of Support

            Form I-131 Application for Travel Document

            Form I-765 Application for Employment Authorization and

            I-693 Report of Medical Examination and Vaccination Record which can be obtained from a USCIS approved Civil Surgeon.

            Form I-131 and I-765 are optional and required no filing fee when applying for AOS

            Forms and instructions can be found here: https://www.uscis.gov/forms

            Make sure forms are current before sending

              *- Copy of Marriage Certificate and translation
              *- Two Passport Style Photographs of the Petitioner (Placed in a plastic bag, attached to a paper)
              *- Two passport Style Photographs of the beneficiary (Placed in a plastic bag, labeled with name)
              *- Check in the amount of US$535 for I-130
              *- Form I-130A
              *- Form G1145

              And this for i-485:
              *- Copy of passport page with non-immigrant visa
              *- Copy of passport's biographical page
              *- Copy of Marriage Certificate and translation
              *- Copy of Birth Certificate and translation
              *- Two passport Style Photographs of the beneficiary
              *- I-693 Report of Medical Examination and Vaccination Record (Completed by a Civil Surgeon sealed in an envelope)
              *- I-864 Affidavit of Support, filed by the petitioner
              *- Form G1145
              *- Check in the amount of US$1,225 for I-485 & Biometrics Fee
              *- Form G1145

              and this for i-765:
              *- Form I-765, Employment Authorization
              *- Copy of passport's biographical page

              3 in 1 package.

              -I think I have to put the i-94 in one of the forms

                Correct, all three in same package, place G1145 at the top. I place my i-94 in both I-130 and I-485, just my preference and a cover letter will be nice too ( not a must)

                    Make a copy of everything you send to USCIS for yourself.
                    Don't send original documents
                    Maybe helpful to include a few pic, joint accounts/utility bill in same package (not a must) you will have to take them with you to the interview anyways

                    As long as your marriage is authentic and you tell the truth on the forms and at the interview you should be OK
                    the hardest part is the waiting.

                      Hi

                      Don't you have to wait until the biometrics interview to take the medical report? Would it still be valid if sent when applying? I read on the website that it may not be valid when they finally open it and persons should do the medical a little before the biometrics interview

                        The I693 is a part of the AOS package, if it is not send with the initial package you will get RFE for it. So no harm in not doing it since some people may be concerned about its validity expiring before they get the interview, but a RFE will prolong the process.
