  • Filing i130 and i485 together

    Hello:
    My friend submmited i130 and i485 together because she married a us citizen, she has a minor daughter and she also file the i485 but didn't file the i130 because she tought it was included in hers i130. Her daughter's package was returned and now she had to include the i130, with the fee

    my question is, initicially, the i485 fee for her daughter was $750 because it was filing together with the mother, now, do the fee still the same $750 o must be $1,140? Because the are processing the mother's i130 already, is this considered now separately?
    They understand that the $535 fee for the i130 must be added, but the application were sent together.

    Well according to the USCIS website, children under 14 is $750 for the i485 when filing together. The i-130 is one standard fee of $535 no matter the age. Since her application is now processing when she sends her daughter's it will now be considered separately, yes, so I guess she will have to pay 1140. Did she include work authorization in her package? Also, was her total for herself $1760?

      I'm very sorry, that seems like a very expensive mistake to make

      Just to clarify, was the child's application rejected outright, or did she get a Request For Evidence asking for a copy of the I-130 receipt or approval notice?

        They return the minor I485 and all documents,
        reason :your priority date could not be established. please resubmit your application with the proper documentation
        The following documents may be provided
        - Your original form I130 (Petition for Alien Relative ) if you are filing concurrently

        Copy of your Form I797 if the I130 petition has already been filed/approved or other evidence that an immigration visa petition has been filed/approved on you behalf.

        Please be sure to complete the application fully, submit the appropriate fee, and include all required supporting documentation.

        She is ok to add the I130 with the fee of $535.00, our question is the fee for the I485 if you file together with the mother is $750. if they file together, thing that they did, but now that they returned the minor application is considered together or no,

        because if is not file together the fee is $1140
