  • regarding re entry to US on b1 visa

    Hi,
I am SriKiran I hold a valid b1 visa with multiple entries.
I travelled US in April 2017 and I got I-94 till may 6
On April 20 th I applied for extension for 2 months and till May 11 I had
    no receipt number.
After applying extension I called every alternative day from April 25th but
all the time I have been asked to wait for 3 weeks then only uscis will
able to provide info on receipt number. Finally on may 10th I came to know
that my extension is rejected because I sent I 539 older form which is no
longer accepted. After that I left US very next day May-11.

I want to know I overstayed for 5 days that too it's because of information
not reached to me on time even after calling USCIS will this have any
effect on my next entry to US.

I would advise to check your visa status viz., if the B1 is still valid or has been cancelled due to the overstay. Overstay typically results in automatic existing visa cancellation, no exceptions. You can reapply and explain the situation to the VO.
Just an opinion; Not legal advice.

Scientist there is nothing to check. His B-1 visa was automatically void the day after the "admitted until" date on his I-94 stamp. Like you said, no exceptions

Srikiran, you're not statutorily inadmissible as a result of the overstay. The consular officer can grant you a new B-1 visa if he or she wants to. The fact that you violated the terms of your status will adversely impact the consular officers assessment of your immigrant intent. However, you will be in a position to overcome the presumption of immigrant intent with your strong ties to your home abroad. You can persuade the consular officer that your overstay was not an act of bad faith, and that it will not happen again
