  • Renewing F1 OPT Visa while married to USC

Hey guys, I am planning on renewing my expired visa in December 2017 but I will be married to a USC in November. Is there a risk for me reapplying F1 visa so I can continue my OPT while being married? What are other options? Will I get the advanced parole for traveling if we register for marriage and apply now? Thank you.

Since F1 is a strictly non-immigrant intent visa, your visa will be rejected due to your marriage to a USC. Since it usually takes around 90 days (it could be shorter than that, but most likely longer than that) to get your EAD/AP from AOS petition, your best bet would be to get married and file for AOS asap.
Just an opinion; Not legal advice.
