    Default question with immigrant visa

    Hi,

    I am going to India for one month vacation i.e. departing on Feb 09 2007 and coming back on March 09 2007 with my family ( my wife is on H4 visa and my 7months old daughter has US citizenship) and my H1 visa is valid upto Sep 30 2007. My I-140 got approved on July 2006. Some of my friend told me yesterday that there is new immigration rule that when I will depart US there is no problem but when I will come back to US then during entry into US, immigration will ask me for a immigrant visa otherwise I will be not allowed to enter into US as my I-140 has got approved. Is it true? Please help.
