    Default What happens if our H1B limit exp.. waiting for PD

    What happens if our H1B limit expires while waiting for PD to become Current. Do we get extensions too ?

    I believe that backlogs will be done soon now. They are under pressure.

    Default As of today

    1. Up to 180 days you can stay in the country.
    2. AFter 180 days your stay becomes illegal & will automatically come under the 1-10 year bar from entry into the us dpeneding on how much you overstay.
    3. Also as soon as your H1 runs out you no longer have authorization to work.

    The law--- Well first the President has to sign it.
    Then it will have an effective date "Don't know when that date will be". If you fall out of status / become illegal before that effective status "YOU MAYBE in SOUP". The simple moral " GooD thing are on the way but wait a while till you count chickens"

    When President Signs the bill for sure what is the case. Thing is my GC process till I-140 got completed with in an year and am waiting for PD. Case is EB3. I got 26 more months to go though to expire for my H1B.

    Default You will be fine

    Once it becomes law then as soon as you have waited 365 days + you will become eligible for automatic extension of H1 in blocks of 1 year till your GC is done.

    Also as the country quotas of unused numbers will be distributed to over used countries. The Priority dates also will move.

    You are 23 months then you have more than sufficient time. Though I cannot tell you how long it may take to geta GC but at least you don't have to leave the country after 6 years ( Change companies too).
