    Default Employer didnt deduct Social Security. Now what ?

    Hello All,

    I was on H1B since oct 2005 and my employer never deducted social security tax from my paycheck. I didnt notice this earlier. But now i have asked him to fix it from the next paycheck.

    1. Should i pay the social security + medicare tax for 2006 ?
    2. What would happen if i don't pay? I dont want to do anything illegal
    3. Can this effect my green card application in any way if i dont pay the tax for 2006 ?

    It is possible that your empoyer may have assumed that SS Tax is cut by by earlier employer.

    1. You must pay SS Tax when you are filiing income tax return for that year.
    2. You can not avoid it as while filing income tax return social security tax check
    is done and it is on form 1040.
    3. There is no question of you being not filiing SS Tax as you can not avoid filiing income tax return.
    4. It will be illegal to NOT file income tax return when you are supposed to. And this potentially affect your GC.
