    Default question on K3 and I-130

    1) If I file the I-130 petition, why should I file the K3 (i-129F) petition? What are the advantages?

    2) The I-130 petition requires "Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage)".

    Can the affidavits be written by the father/father-in-law? How many affidavits are required? If someone can please tell me what they did for this affidavits.

    This is new , its not on the instructions to previous I-130 forms. Here is the whole section. It says SHOULD submit, not MUST submit lol.Look Below. I didnt submit any of this stuff and mine was approved. All I gave was the marriage license.

    But in answer to your question, yes can be affidavits from father or father in-law, or anybody who knows you. Bacically just a brief letter saying they know you and your wife. That your a good guy and you and your wife are so wonderful, and its a match made in Heaven , Etc. Etc. . Its a real marriage. And they put in their personal info and relationship to you (parent, sibling, friend etc.) . At the end of the letter state this to make it an affidavit: Under penalties of perjury, I swear that the aforementioned is true to the best of my knowledge.

    They just sign it , you dont need a notary. It doesn't say it has to be notorized. But like I said , I didn't give anything of those 6 things. At my interview I did give copy of me and my wifes joint savings account , that was it. Goodluck . Oh I almost forgot, the I-130 from start to finish takes an average of 1 year to complete, The K-3 from start to finish takes average 6 months . So basically, you pay an extra 190 dollars to have her here 6 months sooner. Its just another way for them to squeeze another 190 dollars from you . If they cancel the K-3 visa and use the time they spend on processing the K-3 visas to process the I-130's , they would get done with I-130's probably 6 months sooner, it would be a faster process. But then they wouldn't get the extra 190, the 100 for visa application at embassy, the extra money for medical , etc . etc. . Its all the game of Politics. Ok goodluck.

    NOTE: In addition to the required documentation listed in 1)through 4) above, you should submit one or more of thefollowing types of documentation that may evidence that bonafides of your marriage:
    1) Documentation showing joint ownership or property; or
    2) A lease showing joint tenancy of a common residence; or
    3) Documentation showing co-mingling of financialresources; or
    4) Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
    5) Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
    6) Any other relevant documentation to establish that thereis an ongoing marital union.
