    Default How long fresh H1 valid without starting work

    I got an H1 approval through a consultant which is valid from Oct 2007. But I am currently expecting and due in December. I might not be able to find a job until Feb'08. In such a case what happens to my H1.

    Is there a time frame within which I have to join work to maintain my H1 status. Or Is there a way around to extend it for a couple of months.

    Thanks a bunch for any suggestions/advice...

    You will be out of status when you dont get a paycheck at the end of october. But I am sure your consultant who deals in illegal practices can hide this very well.

    ---- There is no time frame to join as long as your H1, I-94 and if applicable H1 Visa are valid. This will hold true if the employer does not revoke/cancel the H1 petition by writing to the USCIS

    ---- The best option is to talk to the employer about your options and take a decision

    If the consultant generates fraud paychecks, then I guess I will be liable for all the taxes associated with the employer and employee...Is there any workaround this.

    as i mentioned check the www.uscis.gov there is an exception for maternity leave. In your case your best course of action it apply for a change of statius to dependent one and then try to capture the earlier H1 date. You should not be subject to cap as you have been counted against it once.
