Thread: AP Vs EAD

    Default AP Vs EAD

My spouse has applied for I485. I have received my AP and am planning to travel to India on Jan 21st. I am using my AP as I am on H1 and my visa is not stamped on my Passport. I have following questions:

    1. If I travel on AP do I need to show my approved EAD at the port of entry. My EAD is not yet approved.
If I do need to have EAD before travelling then can I apply for EAD at local INS as my RD was 10-13-2000 (based on 90 day rule).

    2. My spouse is not travelling with us, and my son is travelling with me on his H4 based on the rule that dependents of H1 do not need AP if the applicant is working for the same employer as an nonimmigrant.
Will there be any problem? What documents shall we take.

    Your reply is highly appreciated.
    Thanks

Is EAD required when you return from India on AP while H-1b still valid but not stamped?
