New H1b under cap exempt

I am on L2 visa and working for a good company in LA. I got my H1b approval from a desi consultant. However the company I work for claims that they can apply for a new H1b now under cap exempt and I have no risk of losing my existing H1b approval.

Is it true that being already counted inside the cap for this year, they can apply for a premium H1b now as a new application?

Is there any risk to my previous H1b?

No risk, in fact you will be able to choose either H1 for work.
