    Default Documents sent back to USCIS

    Hi, friends i attend the visa interview on 1st week of october 2007 , i was given a 221g to submit the documents on last week on october 2007 i submit all the documents ,today i got my passport back but no visa stamped i was given another 221g below is the content,any of you are in the same process kindly let me know my mail id is sagiprabhu@yahoo.com


    Based on the documents you have submitted to us, and the information elicited in your interview with an American Consular Officer, we are not able to issue you an H-1B temporary work visa, because:

    Your petitioner does not appear to be either able or willing to provide qualifying employment in the United States in accordance with appropriate laws and regulations.

    In accordance with United States law and Department of State guidelines, action on your case has been suspended, and the 1-129 Petition for a Non-Immigrant Worker filed on your behalf will be returned to the United States Citizenship and Immigration Services (USCIS) with a memorandum explaining the facts of your case as presented to us at the time of interview. The
    U.S. Consulate in Chennai is no longer handling your case, and will be unable to give you any information on the status of your petition.

    For your information, your visa was refused today under Section 221 (g) of the Immigration and Nationality Act (INA). Essentially, this section states that a visa cannot be issued to anyone whose application does not appear to the Consular Officer to meet the requirements of the INA or of the regulations thereunder.

    I too received the same on 25th of October .. how many days did it take for them to contact you when you refused for the 1st time?

    u need to expose such employers so that other ppl DO NOT apply thru them

    Default I-129 Petition returned back to USCIS by Chennai Consulate.

    Hi Friends,

    Even I am facing the same situation as (sagiprabhu & sandeep_in)...

    I dont have any clue what will be the next step...

    If any one know what to do.. Please let us know..

    Friends today had a discussion with the consultant he has told me they will do every possible step to get the visa ASAP,there Attronet will take care of this issue and told me not worry much as they had this type of problem before and have over come in 3-months

    I am in same situation.

    My emp in us assured me that they will see what they can do once the USCIS report back to them about this refusal by US Consulate New Delhi via a letter.

    Lets see what happens.

    Dear Prabhu,

    You done the same mistake as most of ppls do, applying from non productive employers..

    Sorry to hear your case..I hope you wont do same mistakes again..

    Finaly i got my Visa stamped guys,thanks for the forum it was encourageing if you have job and your employer is good you will get you visa , mine is a desi company based in nj

    Thank you for letting us know. I had my interview on July and my case was sent back to USCIS too. It's almost 4 months and I have not heard anything from USCIS. Actually I was thinking that there is no chance for my case but your information gave me a new hope.

    I would really appreciate if you let me know if you had another interview after your case was reaffirmed. If yes, please let me know the questions that VO asked you.
