    Default Eb-4

As of September 2007 I'm working as a full time teacher at the Jewish day school that willing to be my petitioner.

I first received my R-1 visa on June 2004.

    From 2004 - to 2007 I worked as a teacher for a local Temple (working 15 hours a week)

As of September 2007 I'm employed additionally by a local Jewish day school
( an additional R-1 petitioner), as a full time (40 hours per week) Hebrew teacher, and plan to continue working at the school for the next year.

My 5 years of holding the R-1 visa will be expired on June 2009.

Please advise if I can apply for the EB-4 and what are my chances to get it.
    Thank you in advance,

    Miri

Default it is very possible if you try

Yes, I think you can try. Yet right now you have to wait until your full time job has been at least two years. USCIS will check your paychecks, W2 forms and other documents to show you are really doing a full time job.

Another issues is that while you are waiting for your I-360, you have to keep your legal status, I mean keep your R-1 visa still valiid. I-360 may need to wait to three months, if you are lucky, or 6 months.

    Good luck
