I am on H1 with and my position is about to be eliminated. My Consular processing interview is 2-3 months away. My I-140 should be approved any minute now. Can I go on leave of absence with my company and still go for the Consular Processing interview?
The company has said they would be willing to rehire if the business conditions improve.
Is it legal on H1 and how long can I go on leave of absence? What kind of reasons can be given to go on leave of absence?
