    Default I''m on H4 and got the Approval for H1B- Cruise to mexico will affect my new H1 ?

    HI,

    I am on H4 visa and that expires in Sep 2009. My spouse changed the company and I got the new H4 validity till 2010. My First I-94 expires in Sep 2009 but the extended one expires in 2010 (I have both right now )

    I got approval for the H1 Visa (effective from Oct'2008).
    We have planned of going to Mexico cruise in SEP 1st week for 5 days.

    Should I need to get the H1 Visa to come back ? becazI Read like for less than 30 days just having any valid visa will do)

    Will I get a new I-94 when we disembark the ship ?
    OR does it effects my H1 status in any manner ??
    Does at the POE..Officer issues me new I-94 ?

    Appreciate your suggestions. Thanks in advance for your time...

    You will re-enter on H4 status since your cruise is in early Sept. I understand that your currently have the I-94 for your H-1B in your hand; if this is the case, it will take effect on date specified. If you do not have the I-94 for H-1B status, you will need stamping and I-94 before beginning work.
