L1 to H1 + COS + India travel

Hi,

Facts:
1. I worked till sept 08 in the US on L1 visa for company A
2. I have an approved H1 (Oct 08) with COS from company B (I have the orginal I797)
3. I am in India for sept and oct 08.
4. In Nov 08 I plan to get back & Continue with company A(L1) for 2/3 months and then move to directly to a new company C ?

What do I need to do for that & and typically how long does it take ?

If you never work for B, C must file a new petition not under cap and you must wait for approval notice. It will be faster to get stamping and enter on H1B than to wait for normal COS.

FYI: I dont yet have an offer from C.
wrt I797 from B - getting H1b stamped and entering on H1b will mean I have to work for B , right ? I dont want to do that for several reason.

So, if my understanding is right:
1. dont do any stamping etc in India
2. enter US on L1
3. Let C make an offer and then file for new petition with COS- which is not a challenge . Then join C.

Please correct my understanding.
