Regarding the petition for alien fiance, I just want to know....Can a same-sex relationship be a valid petition for fiance visa?, Since same sex marriage is legal in some states like California.

Federal law applies for US immigration/visa. Therefore, gay marriage is valid in California does not mean anything for visa purpose.

By the way, gay marriage is no longer valid in California anyway. They are currently valid only in Massachusetts and Connecticut. But, still that does not mean anything for US immigration purpose.
