    Default employer delays visa stamping

    This is my status

    Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
    Current Status: Approval notice sent.
    -----------

    However because of the current US/global
    recessions my employer says that they may send
    my packet/documents needed for visa stamping maybe around next year. This is about the third promise that has been delayed since June, having
    different reasons after another.

    Now how long can an employer delays my visa
    stamping for numerous reasons?
    Can I transfer to another employer without
    the document needed for my visa stamping?

    Thanks for any info...

    The employer can delay indefinitely, if not terminate you if they want.

    You can transfer if you have a copy of the approval notice or the receipt number. Cap-exempt.

    I know my receipt number.
    So what are the procedures if I want it to be transfer to another
    company?

    hmmm,

    Its a big process. You have to find an employer, who would file a FRESH h1, which is cap exempt, then you get a tracking code, after that you get approval notice (hopefully) and then you have to get it stamped (since you said you have not got stamped from the present employer) and then fly to US

    -- All these process would take some where around 5-6months, and finding an employer who transfers like this is pretty tough considering present market situation.

    So negotiate with the present employer which might save you time.
