Name Change on I-797

  • Name Change on I-797

    Hello,

    My wife joined me on H4 visa with her maiden last name and then we applied for her H1 Visa 2 years back. In the mean time we visited India and we got her last name updated on passport with after marriage name. Everything was going fine she got her social security and everything with her after marriage name.

    But last weeek when we went to apply for her drivers license, it was a big problem. Since on her Passport she has after marriage last name and on I-797 (Notice of approval for her H1) she has before marriage last name. SOS people asked me to get her last name updated on her I-797.

    Please help me out with the process.

    If she is on H4, why is the I797 coming into picture here? As long as I-94, SSN and passport match, she is good to go.

    I797 can be amended by the company to show married name.

      Thanks for the Quick response and sorry for the confusion caused.

      Since she got her H1 and now she is working from past 1 year on her H1.
      As per SOS we need to notify USCIS or some other immiration related agency for change of name and get the name corrected on I-797.

      I need help with that.

        What is the name on the latest I-94 for H1b? Like I said earlier, employer has to amend I797 to get the record corrected.

          Thanks again.

          Her latest I-94 has before marriage last name, which doesn't match with her last name on passport.

          What kind of procedure do we need to follow to get it changed, i talked to my employer and it looks like he is not having any clue of what needs to be done.

            That is wrong! How and/why was the I-94 filled with her maiden name?

            If the employer has no clue, he has to talk to a lawyer. Passport, I-94, SSN, they all should match. Any discrepancy in names is an issue.

              her latest I-94 came with her H1, that's the reason why she has her old last name on I-94.

                Employer has to fix it. It is an amendment to I129. Ask them to talk to a lawyer. It is their fault in the first place to fill out the name wrong.

                    Same situation.. please help me

                    Hi,

                    We married in May 2009 and we both are on H1B. We came to USA in June 2009 and then my wife extended the H1B Visa and she got 3 years. After this, 2 Months before we changed her name in Indian passport with married last name.

                    Note: My wife new I-94 came along with extended H1B work permit (I-797)

                    Now my question is, is there any necessity we need to change her name in I-797, I-94 and SSN?

                    If we need to change what procedure, We need to follow?

                    Also I have to include my wife in my I-485 application in the near future. So will there be any problem for me because of name mismatch in I-797 and passport of her?

                    I contacted customs office and I was told that, they can do only corrections in I-94 if something wrong was happened at port of entry. They won;t do the name change and they asked me to contact USCIS only.

                    If I129 got amended, will my wife get new I-797 with latest I-94 with new name?

                    Please help me in this.. Thanks in advance.
