    Default H1B RFE recieved....

    Hi All,

My H1B expired in DEC'2008 and i have already applied for H1B extension before it expired but recently i received an RFE for the Extension.

RFE requires me to send the client letter to the INS, but i am not able to get the client letter from the client as the client was not willing to give the client letter. I have the Contract from the client which says about my position, billing rate etc...My question is will this help for the RFE i received as my attorney is saying it will work.

My second question is it better to find another H1B sponsor and apply for a H1B transfer before my attorney sends out the response for RFE to INS. Lets say if the transfer gets approved and extension is denied what happens???

    Thanks in advance

The client contract/work order will work. No point in applying for another H1b as that will not get approved if your current I-94 already expired.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.http://www.immihelp.com/visas/h1b/h1-visa-faq.html

    Hi Aakash:

I am also in same boat. My case,

We applied for H1B transfer on Jan/02/09 (California Service Center - Premimum) and attached pay stub and employement offer letter. First time we did not attach any contract details.

We got an RFE on Jan/09/09, Basically they wanted to know whether i am working on project currently. They are asking to submit contract agreement, client details (client letter - i am not sure this is must or not must).

There are 2 layers between client and my employer and could not get client letter. However, I can provide the following docs,

    1. Contract Agreement Between Employer and First Layer
    2. Contract Agreement Between First and Primary Vendor
    3. Letter from Primary Vendor (stating that i am working their client project).
    4. Primary Vendor Invoices to Client
    5. Time Sheet (Client approval)
    6. Access Card
    7. Work site Photo

Any thoughts. What are chances for approval?.

    Thanks

    Nag,

My extn got approved. My attorney just submitted the contract between the Client and Primary Vendor with all the details like my manager, rate, project i am working etc.,

So it should be fine, you have fair chances.

    All the best,

    Thanks
