    Default Need urgent help from txh1b/subramanya

    Hi Joe,

    1)came to U.S in Nov 2006 on company A Visa & H1 valid till Sep 2009 to CA
    2)Quit company A in and joined company B in Mar 2008 in East(NY)
    3)since it was very cold in NY asked company A if they wud rehire me,and in Jun 2008 company A filed for my H1 Xfr(technically this is not required as the H1 is valid till 2009) the case is still pending,but due to salary issue I didn't join company A and contd with company B.
    4)In Nov 2008 company B laid off me and I requested company A to rehire me and I joined company A and company A again filed for my H1 Xfr in Nov 2008(technically this too is not required as the H1 is valid till 2009),this case is also pending till date
    5)Now company A is telling me to join there offshore operations in india

    Queries

    1) why is Xfr in point # 3 & 4 taking so long
    2) Can I travel while the case is pending and what action items do I have
    3) In case the Xfr gets RFE or denied can I travel back to U.S before expiration of my Visa as I still hold a valid H1B of company A which is valid till Sep 2009

    1. No one can tell.
    2. Travel on pending petition is not recommended. However, if you already have a valid visa and a valid I797 (if A has not revoked), you can very well travel and return using those if you have a job with A. You need not wait for the transfer. I am not even sure why it was applied if they already have a valid petition.
    3. Yes, provided you have another valid petition that was never revoked.
