    Post L1 to H1, reenter and apply again

    I got my visa changed from L1 to H1 in 2008. But I didn't join H1 company, instead re-entered US after Oct 2008 on L1. Can I again submit for a change of status from L1 to H1 this year - 2009 ? Will there be any potential problem for this?

    --You cannot submit. Your H1 employer has to file COS.

    Will there be any potential problem for this?

    --No problem.

    If H1 employer has a job for you then there are no issues. Make sure you will get paid all the time even if there is no work.
