No H1B lottery for this year (2009-2010)

Hi Friends,
I am in the process of submitting my documents to a consultancy for H1B filing.
They told me that that for this year (2009-2010), there will be No H1B lottery as applications are less due to market conditions. Is this correct news of no lottery so all will get visas who apply?

Secondly, they have agreed to pay me 80k$ (on project) and 50k$ (on bench) and ask for 45,000Rs. as caution deposit. How is this deal as per your experience of US ?

Pls reply to my query as i am in a bit of confusion.

The deal is illegal.

I'll ask the crystal ball tomorrow if there will be lottery or not this year
