  • H1 to F-1 with approved I140

    I was on a F-1 visa from 2001 to 2004 worked on an OPT for 6 months and then got my H1-B under the 65,000 cap. I am currently on H1-B status and my employer filed the I-140 last year which was approved in November 2008. Since the entire process started, I have changed my mind and decided not to pursue the GC process and quit my job and go back to school this fall. I have been admitted and now am considering going back on F-1. I will not be leaving the US to get a change of status and if I have to withdraw my I-140, i am willing to do that. As an aside, my spouse is working on a H1-B visa so I can get on H-4 if required to study.
    Any suggestions or if anyone went through this process, please share your experiences.
