    Default I 94 validity and over stay

    Hi,
    I have a question regarding I94 overstay.

    One years ago My h1 B expiry data was Dec 14 ,2007and I got the I 94 upto Dec 24,2007. My company applied for Extension in Aug 2007 but they have messed up and missed the filling. Again they have filed in dec 26,2007 under Antequainte procedure.

    I have to travel India on Jan 3 2008 with a valid receipt of extension due to personal reasons. I got my extended petition on jan 31 with new I94 validity from Dec 14 till Dec 13 2010.

    after 3 months I travelled again on L1 petition.

    Can any body tell me if I was out of status for 12 days? Or it is considered as legal stay.

    If the EOS is approved, why do you think you were out of status? Am I missing something ?

    Default Overstay

    Thanks for ur rely.
    Actually I am filling for labor and there is a columefor overstay. Only that was the situation when I was out of status for couple of days.

    Hence i want to confirm if i was considered as overstayed or not.

    What makes you think you were out of status? Your EOS was approved meaning you were not out of status as per USCIS.
