    Default Spouse on H4/Tourist Visa

    Hi,

    I am currently on a H1B visa. I will be heading to India for my marriage sometime this month. After my marriage, I am planning to get my spouse with me for a few months (maybe 4-5 months). My spouse has been holding a tourist visa for sometime now. What kind of constraints will I face if get my spouse on a toursit visa rather than getting a H4 processed?

    Please advise.

    ---- Why would there be any constraints? However, it is in your interest to get your spuse ontoa H4 visa at the earliest so that you can continue to stay together under the same roof

    I just wanted to know if there are some legalities that I am not looking into. There is only a period of 4-5 months that we will be on this status. We might either be heading back to India or my spouse would be changing her visa status to a L1 at the end of this 4-5 months. Thats the reason we dont want to go through the trouble of applying for a new H4.

    ---- Absolutely, there are no legalities involved here. But do ensure that your spouse is not working on a visitor visa as that leads to complications
