    Default Regarding filing Labor (GC)

    Hello,

My Employer filed my labor 3 months ago. He did not give me any receipt number to verify that he actually filed it. My friends are saying that that labor shouldn't take more than 3 months. I checked with my employer today and he told me that there will be no receipt number from the united states immigration services until the labor is approved. Is this true? If not, what information should I try and get from my employer to make sure that he actually filed the labor for me. I just want to confirm that he filed it three months ago. If not, there is no point in staying with them anymore.

Thanks in advance for taking your precious time to reply to my question.

    Thanks,
    Shervin

    Hi,

As per my knowledge also , for Labor - you do not get a RECEIPT NUMBER as you get in case of I-140 , H1 petition etc from USCIS.

Labor is filed with the State dept of labor and a CASE NUMBER is assigned to the application , and when we file labor - generally Email is send to the Company Contact/attorney that the application (CASE NUMBER : XXXXXXXX) has been received and submitted for processing.

And regarding time period - as now PERM is done online , so they say that it should not take more than 3 months but its not correct. It depends , sometimes it takes more than 6 months also.

For eg) in my case my Labor was approved in 8 months (filed in JUL'08)

Thank you so much. This information helps me a lot. I hope my employer did file my labor. I just didn't know how to confirm this. Thought there will be some receipt number. It is already 6 months now and I will wait for couple of more months.

    Thanks again for your replies.

    Hi,

I can only say , if you can ask your Company contact /attroney that they can send you the EMAIL that they must have received while filing the labor , then its a proof that they have filed.

Secondly , for Labor - they should first give the Job openings(of ur position) in the leading newspapers of the state/place where u r working..so if they did this...so chances are that they have applied

    Regards,
    Abhay
