    Default Green card for my son

    My company is starting to process my Green Card and is now doing a RIR soon . I am on a L1-B visa now. I have a 3 year old son who was born in India and is here with me since Aug 2004.

    I am planning to send him to India for 6-8 months in Jan 2005. Will this effect his green card processing. My question is is he required to be physically present in the US during the whole duraion of the Green card processing?

    He is not required to be present all the time.

    It will take long time for you to get greencard. You can send him for 6-8 months in 2005 and I don't see any problem.

    If you file his I-485, he should be in US to get his passport stamped but that is going to be after few years.
