    Question Advance Parole while filing I485

    Hi, I recently got married to an american citizen (who I've been dating for many years, moving together back and forth to my country and the US). We decided to live here permanently and I'm filing my adjustment of status. I might need to go back to my country before my status is changed, so I was planning to apply for I 131. I just read J1 holders are not eligible. I had a J1 visa that expired in 2007. I'm in the US with a B1 visa now, does anybody know if I'm able to apply for travel documents despite I held a J1? Thank you

    Are you subject to 2 yrs home residency requirement? If you do, then you must first get a waiver. Without the waiver, you can not file for AOS. Check the new 2009 skills list by State Dept. They have removed quite few countries from the new list.
